SWEEPSTAKES PERIOD: The Fidelity Invest in Your Selfie Sweepstakes (the “Sweepstakes”) begins 12:00 a.m. Eastern Time (“ET”) on January 17, 2024 and ends 11:59 p.m. ET on February 17, 2024 (“Sweepstakes Period”).

ELIGIBILITY: This Sweepstakes is open to legal residents of the 50 United States and D.C., 18 years of age or older as of date of entry. The following individuals are not eligible to enter or win: Officers, directors, independent contractors, sub-contractors, and employees of Fidelity Brokerage Services LLC ("Sponsor"), Don Jagoda Associates, Inc. (“Administrator”), and any officers, directors, independent contractors, sub-contractors or employees of Sponsor’s or Administrator’s parent companies (as applicable), subsidiaries and affiliated companies; their distributors, contractors, web design, advertising, fulfillment, and promotional agencies; and other individuals or entities involved in the administration, development, fulfillment and execution of the Sweepstakes (collectively, the “Sweepstakes Entities”) and all of such persons’ immediate family members (e.g. spouse, parent, child, sibling, in-laws and/or the “steps” of each) as well as any non-related household members of each); employees and registered associates of FINRA firms, government officials and employees including managers and administrators of public universities and health care facilities. The Sweepstakes is intended solely for viewing and participation in the United States and shall be construed and evaluated solely under United States federal, state and local laws. The Sweepstakes is void where prohibited, taxed or restricted by law. Winning a prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: There are two (2) ways to enter this Sweepstakes:

Entry Method #1: During the Sweepstakes Period, sign into your Instagram account and create a Post or Story with at least one (1) photo or a video showing yourself doing an activity you are passionate about or doing that thing you dream about doing more of. In your Post or Story you must tag @Fidelity and include the hashtags #investinyourselfie and #fidelitysweepstakes. You may also enter via TikTok by signing into your TikTok account and creating a TikTok Post with a video or photos showing yourself doing an activity you are passionate about or doing that thing you dream about doing more of. In the caption of your TikTok Post you must tag @Fidelity and include the hashtags #investinyourselfie and #fidelitysweepstakes. An Entry submitted via Instagram or TikTok will be referred to as a “Social Media Entry.”

To enter the Sweepstakes via these methods, you must have an Instagram or TikTok account and if entering via Instagram have your account settings set to public and not private. An Instagram or TikTok account can be opened for free by downloading the Instagram or TikTok application from the Apple store or Google Play or by visiting www.instagram.com or www.tiktok.com, and a compatible mobile device may be required.

Entry Method #2: Hand print your name, complete mailing address, email address and telephone number on a plain 3”x5” piece of paper and mail it in a hand-addressed stamped envelope to: The Fidelity Invest in Your Selfie Sweepstakes, P.O. Box 7690, Melville, NY 11775- 7690 (“Mail-in Entry”). Mail-in Entries must be postmarked by February 17, 2024 and received by February 26, 2024 to be eligible. Limit one (1) Mail-in Entry per envelope.

All Social Media Entries and Mail-In Entries submitted shall herein also be referred to as the “Entry” or “Entries.”

Limit of one (1) Entry per person per each of the social channels (TikTok and Instagram) or up to two (2) Entries via Mail-in Entry(ies). The maximum number of Entries per person via all Entry methods is two (2) in total. Whether an entrant is eligible to participate in the Sweepstakes is a determination made in the sole discretion of the Sponsor. Sponsor may void and render ineligible any entrant that Sponsor determines in its sole discretion to have violated or attempted to violate or subvert the Sweepstakes Official Rules or applicable policy, rule, law, or regulation. Entrants who submit multiple Entries in excess of the Entry limit may be disqualified from participating in the Sweepstakes and any additional Entries made by the same entrant are void. Any attempt by any entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such Entries and that entrant may be disqualified. Use of any automated or computer system to participate is prohibited and will result in disqualification. Normal phone/data and usage charges imposed by your phone service may apply. Standard data rates may apply. This Sweepstakes and the awarding of the prizes is in no way sponsored, endorsed or administered by, or associated with, Instagram or TikTok. You understand that you are providing your information to the Sponsor and not to Instagram or TikTok.

Mechanically reproduced Mail-in Entries are automatically void. The Sweepstakes Entities are not responsible for lost, late, incomplete, invalid, unintelligible, illegible, damaged, misdirected, returned or postage-due Mail-in Entries, which will be disqualified, or lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's mobile device/computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of a Social Media Entry entrant, the authorized account holder of the email address associated with entrant’s Instagram or TikTok account will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winning entrant(s) may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win. Entries will not be judged.

Social Media Entries must be unique and must comply with the “Entry Requirements” set forth below.

Social Media Entry Requirements:

• Any Social Media Entry caption, including required information as outlined above, must not exceed two hundred eighty (280) characters, including required hashtag and user tagging information, and must be in English.
• Entrants may not submit any Social Media Entries using content that is anything but entrant’s own, original content. Entrants must not copy, modify, or otherwise plagiarize from any unoriginal source or use any copyrighted, trademark or similarly protected materials without express permission of the owner of such materials.
• Entrants may not submit republished content or materials that have been previously submitted in a giveaway or promotion of any kind or previously exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means.
• Social Media Entries must not contain any content that is false, inaccurate or misleading.
• Social Media Entries must not contain material that is inappropriate, indecent (including, but not limited to, nudity, or pornography), profane, obscene, hateful, tortious, defamatory, slanderous, libelous (including words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group), violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), or illegal (e.g., underage drinking, substance abuse, computer hacking, etc.).
• The Social Media Entry must not contain or depict material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination, including without limitation, discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. The Social Media Entry must not contain or depict material that is threatening to any person, place, business, group, or world peace or contain words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group.
• The Social Media Entry must not contain any content that infringes or may infringe third party rights, including, without limitation, any copyright, name, trademark, logo, trade dress, or other personal or proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity or make reference to any commercial/corporate advertising (including but not limited to corporate logos, brand names, charities, slogans, political, or religious statements), or be otherwise objectionable. Without limiting the generality of the foregoing, publicly displayed and publicly accessible Sponsor content, materials, or products are permitted to be displayed in Social Media Entries submitted for this Sweepstakes.
• The Social Media Entry must not include the name, image, voice or likeness of any person for which you have not obtained (i) their permission to use their name, image, voice or likeness in the Social Media Entry and (ii) the right to assign and grant to Sponsor the rights in the Social Media Entry that are described in these Official Rules.
• The Social Media Entry must not include any representation of celebrities, athletes, musicians, or any other third-party (public or private), include any anti-social, political or religious groups, any commercial solicitation or promotional materials or name, address, phone number, or URL address. Social Media Entries must not contain advertisements, personal solicitations or commercial solicitations.
• The Social Media Entry must not disparage persons or organizations associated with Sponsor.
• The Social Media Entry must not depict or reference any of Sponsor’s competitors or competitor’s products.
• Entrant must not promote or make any recommendations of securities, investment accounts, digital assets / crypto or investment strategies in any way. Entrants must not discuss specific securities or investment vehicles including but not limited to common stock of publicly-traded companies, registered investment companies such as mutual funds or exchange traded funds or any digital asset / crypto.
• The Social Media Entry must not disclose any information that is sensitive, private, confidential or personal, including information regarding Entrant’s or anyone else’s investment accounts with Fidelity or any other financial institutions.
• The Sponsor maintains sole discretion to determine whether a Social Media Entry violates any of these requirements or potentially injures Sponsor’s reputation or image or violates any policy or mission statement of Sponsor in any way. Such Social Media Entries will be void and entrants agree that Sponsor has sole discretion to make such determinations. Entrants agree that they have no right, recourse, standing or other remedy in law or otherwise to dispute Sponsor’s determination regarding whether a Social Media Entry is void.

By submitting an Entry, you agree that your Entries become the sole property of Sponsor. In addition, you agree that, by submitting a Social Media Entry, you grant to Sponsor a worldwide, royalty-free, perpetual, non-exclusive right and license to copy, distribute, and display each submitted Social Media Entry (and any portion thereof) in any media (including Fidelity Social Media platforms), and with right to use, copy, modify, edit, and create derivative works therefrom, and agree to execute documents confirming such right and license at Sponsor’s reasonable request. By entering, you understand that your Social Media Entry may be screened by the Sponsor and, without limiting Sponsor’s rights, your Social Media Entry may be posted online or featured in Sponsor’s social media channels or other advertising, in Sponsor’s sole discretion, to be viewed by members of the general public for public viewing. By entering via Entry Method #1, each Entrant warrants and represents that his/her Social Media Entry is original, has not been previously published or won any award, does not contain any material that would defame or otherwise violate or infringe upon the rights of any third party, including patents, copyrights, trademarks or rights of privacy or publicity, and will not violate any federal, state or local laws or ordinances and otherwise complies with these Official Rules. Sponsor reserves the right in its sole and unfettered discretion to disqualify any Entry that it believes does not comply with these Official Rules or that is not consistent with the spirit or theme of the Sweepstakes.

RANDOM DRAWING: The Grand Prize winners will be selected in a random drawing to be held on or about March 1, 2024 from among all eligible Entries received/postmarked during the Sweepstakes Period. The random drawing will be conducted by the Administrator, an independent judging organization. By submitting an Entry, entrants agree that the decisions of the Sponsor and the Administrator are final and binding on all matters relating to the Sweepstakes. The odds of winning a prize depend on the total number of eligible Entries received in accordance with these Official Rules.

PRIZES: Ten (10) Grand Prizes: $1,000 cash, awarded in the form of a check. Prizes are non-transferable. Entrants agree to comply with all applicable federal, state and local taxes and further agree that any tax liability or information is sole responsibility of the entrant.

NOTIFICATION OF WINNER: The potential winners will be notified of their selection as a potential recipient of a prize via email, U.S. Mail or a Direct Message on Instagram or TikTok, depending on method of Entry, by Sponsor (or Administrator on Sponsor’s behalf). Entrants must agree to comply with reasonable requests of Sponsor/Administrator to provide personal information, contact information and supporting documentation sufficient to identify Entrant and verify that Entrant is eligible and has complied with all requirements of the Sweepstakes, including the Official Rules, and all applicable rules, laws, and regulations. Entrants who do not sufficiently reply to a Direct Message seeking such information within seventy-two (72) hours may be disqualified. Sponsor and Administrator assume no responsibility for direct messages, emails or other communications with entrants that are undeliverable or unread or inaccurate for any reason, including technical issues that result from entrant or third-party settings or activity. Winners will then be required to complete a Declaration of Eligibility, Release of Liability and a Publicity Release, and Assignment of Rights (where legal) (“Prize Documents”) and return Prize Documents as instructed within three (3) calendar days of attempted notification. Failure to timely deliver complete and accurate Prize Documents may result in disqualification. Potential winners are subject to verification by Sponsor or Administrator, and verification of each potential winner is final and binding in all matters related to the Sweepstakes. Sponsor reserves the right to perform a background check, internet, and/or social media review on the potential winner, who agree to provide any verification or authorizations necessary in connection with background check. Sponsor will have the right, in its sole discretion, to disqualify any potential winner if the background check, internet, and/or social media review on such winner reveals conduct, information or history that, in Sponsor’s determination, may be harmful to Sponsor or Sponsor’s image or reputation or with which Sponsor does not wish to be associated.

LIMITATIONS OF LIABILITY: The Sweepstakes Entities are not responsible for lost, late, delayed, inaccurate, incomplete, postage due or misdirected Entries, interrupted or unavailable network/app servers involved processing Entries, app/internet access or other connections, miscommunications, failed telephone or computer transmissions/failures of any kind or jumbled, scrambled or misdirected Entries, or for phone, electrical, network, computer hardware or software or program malfunctions, inability to upload or download any information in connection with participating in the Sweepstakes, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person or person’s computer/device or property related to participating in the Sweepstakes. Persons found tampering with, abusing any aspect of this Sweepstakes, or violating these Official Rules, will be disqualified and may be subject to prosecution. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

GENERAL CONDITIONS: By entering this Sweepstakes and/or accepting a prize as a selected winner, each entrant/winner agrees that they have read these Official Rules and will be strictly bound by them. Sponsor has sole discretion to determine whether an entrant has violated or attempted to violate the Official Rules in any way and entrant agrees that Sponsor's decisions shall be final in all matters pertaining to this Sweepstakes and the prizes awarded. By accepting a prize, entrant grants Sponsor the right to use their name, address, photograph, Entry and likeness for advertising, publicity and promotional purposes and for any other purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation or permission, except where prohibited by law. All federal, state and local laws apply. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, viruses, tampering, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes and award the prizes in a random drawing from among all eligible Entries received prior to cancellation and all eligible Mail-in Entries received. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. No more than the stated number of prizes will be awarded.

DISPUTE ARBITRATION CLAUSE: Except as set forth herein, for all controversies that may arise between entrant, on the one hand, and the Sweepstakes Entities, on the other hand, (for purposes of this clause, the “Parties”) that arise out of or in connection with the Sweepstakes, the Parties agree that such controversy shall be determined and resolved by arbitration conducted in accordance with the Commercial Arbitration Rules and Mediation Procedures of the American Arbitration Association (the “AAA Rules”). The arbitration shall be conducted by a panel of three arbitrators, who shall be appointed in accordance with the AAA Rules, and shall take place in Boston, Massachusetts. You understand that judgment upon any arbitration award may be entered in any court of competent jurisdiction. No person shall bring a putative or certified class action to arbitration, nor seek to enforce any dispute arbitration agreement, against any person who has initiated in court a putative class action or who is a member of a putative class action who has not opted out of the class with respect to any claims encompassed by the putative class action until: (i) the class certification is denied; or (ii) the class is decertified; or (iii) the customer is excluded from the class by the court. Such forbearance to enforce an agreement to arbitrate shall not constitute a waiver of any rights under this agreement except to the extent stated herein. However, the foregoing shall not preclude a Sweepstakes Entity from seeking and obtaining preliminary restraining orders, preliminary injunctions or other equitable relief from a court of competent jurisdiction at any time, including prior to the commencement or completion of the procedure set forth herein.

Each Party acknowledges (1) that each Party is giving up the right to sue the other Party in court, including the right to a trial by jury, except as provided by the rules of the arbitration forum in which a claim is filed; (2) Arbitration awards are generally final and binding; a Party’s ability to have a court reverse or modify an arbitration award is very limited; (3) The ability of the Parties to obtain documents, witness statements, and other discovery is generally more limited in arbitration than in court proceedings; (4) The arbitrators do not have to explain the reason(s) for their award unless, in an eligible case, a joint request for an explained decision has been submitted by the Parties to the panel at least 20 days prior to the first scheduled hearing date; and (5) The rules of some arbitration forums may impose time limits for bringing a claim in arbitration. In some cases, a claim that is ineligible for arbitration may be brought in court.

PRIVACY: Any personally identifiable information and any other personal information collected during your participation in this Sweepstakes will be collected by Sponsor or Administrator and used by it and its agents for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules, for the uses described in these Official Rules and in accordance with Sponsor's Privacy Policy, posted at https://www.fidelity.com/privacy-policy and as allowed by law.

GENERAL RELEASE: Each entrant hereby agrees to release, indemnify, and hold harmless the Sweepstakes Entities from any claims, actions, damages, losses or injury of any kind including but not limited to personal injury or death, resulting from participating in the Sweepstakes or from acceptance, use or misuse of a prize awarded or participation in any prize-related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and/or claims of third parties. Entrants agree that the Sweepstakes Entities have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express, or implied (including but not limited to the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Sweepstakes or to the prizes. Under no circumstances should entrants give a Fidelity account number, or any information regarding their account, over the phone or via mail, in connection with this Sweepstakes.

WINNERS LIST: For the first initial, last name, city and state of the winners, available for ninety (90) days after February 17, 2024 send an email to: winners@dja.com with “Fidelity Invest in Your Selfie Winners (11-2737-13)” as the subject line. Winners List will be sent after the prizes have been awarded.
